Prepare to Put On a “Mini-Trial” If You Are Unhappy With Your Foreclosure Mediation

If you are not happy with the outcome of your Nevada foreclosure mediation you can file a Petition for Judicial Review with the District Court. Petitions for judicial review from foreclosure mediations seeking a determination of bad faith participation and sanctions pursuant to NRS Chapter 107 and the NRCP shall be subject to the Administrative Order. You will need to file it within 15 days of the conclusion of the mediation process. You may have to file Memorandum of Points and Authorities and prepare a Reply to the Opposition to the Petition.

Once the proper documents are timely filed with the court, you will need to try your case in front of the judge and follow all codes of trial procedure. Witnesses may be called. You will need to properly admit evidence to the court. You will likely have to try the case against a seasoned bank attorney.
